Once the retention period expires, personal data shall be deleted. You may contact us about your data rights at any time. Some information may need to be retained to meet legal obligations or resolve outstanding matters.

5. HOW DO YOU GET MY CONSENT?

We use information you submit to respond to your enquiry or handle your order. Depending on the purpose and applicable law, this involves steps requested by you, performance of a contract, legal obligations or our legitimate interests in providing support and securing the service. Newsletter subscriptions and optional tracking rely on your consent; contacting support does not subscribe you to marketing.

For cookies and similar technologies that are not strictly necessary, we ask for your consent through the cookie consent banner shown on your first visit to the website. The banner allows you to accept all cookies, reject all non-essential cookies, or customise your choices category by category (Strictly necessary / Analytics / Marketing). Non-essential cookies and tracking scripts (such as Google Analytics, ShareASale and Awin) are only loaded after you give that consent. No analytics or marketing categories are pre-selected.

You may change or withdraw your consent at any time by clicking the “Cookie Settings” link in the footer of any page on this site, or by sending us your request via the contact information or contact page. Withdrawing consent will stop further loading of the relevant trackers and we will delete the analytics cookies set on our own domain; cookies set by third parties on their own domains can additionally be cleared through your browser.

7. HOW WE SHARE INFORMATION

Information about our customers is an important part of our business, and we are not in the business of selling it to others. Therefore, we share customer information only as described below.

Third-Party Service Providers. We employ other companies and individuals to perform functions on our behalf. Examples include processing payments (Stripe), creating the platform and hosting the website, delivering the products (courier companies), sending email, analyzing data (Google Analytics), affiliate tracking (ShareASale, Awin), creating ads, providing marketing assistance, providing search results, and links. They also have access to personal information needed to perform their functions, but they may not use it for other purposes.

These third-party services and tools may have access to personal information needed to perform their functions. However, they may not use that information for other purposes. Information shared with these third-party services will be treated and stored in accordance with their respective privacy policies and our Privacy Policy.

Business Transfers. In the event that Somni creates, merges with, or is acquired by another entity, your information will most likely be transferred. Somni will email you or place a prominent notice on our website before your information becomes subject to another privacy policy.

Protection of Somni and Others. We release personal information when we believe release is appropriate to comply with the law, enforce or apply our Terms and conditions and other agreements, or protect the rights, property, or safety of Somni, our users or others. This includes exchanging information with other companies and organizations for fraud protection and credit risk reduction.

With Your Consent. Other than as set out above, you will receive notice when personally identifiable information about you might go to third parties, and you will have an opportunity to choose not to share the information.

Anonymous Information. Somni uses the anonymous browsing information collected automatically by our servers primarily to help us administer and improve the website. We may also use aggregated anonymous information to provide information about the website to potential business partners and other unaffiliated entities. However, this information is not personally identifiable.

Email Address. The email address you supply to us to receive our email communications will never be rented or sold to a third party.

8. PROTECTING YOUR INFORMATION

We work to protect the security of your information during transmission by using Secure Sockets Layer (SSL) software, which encrypts the information you input. For example, if transactions are processed on the website, transaction information is transmitted to and from the website in an encrypted form using industry-standard SSL connections to help protect such information from interception. In addition, we restrict authorized access to your personal information to those persons who have a legitimate purpose of knowing that information to provide products or services to you and those persons you have authorized to have access to such information.

Somni follows generally accepted industry standards to protect the personal information submitted to us, both during transmission and once Somni receives it. However, no method of transmission over the Internet or method of electronic storage is 100% secure. Therefore, while Somni strives to use commercially acceptable means to protect your personal information, we cannot guarantee its absolute security.

We will not sell, distribute, or lease your personal information to third parties unless we have your permission or are required by law to do so.

10. CALIFORNIA PRIVACY RIGHTS

CalOPPA is the first state law in the U.S. to require commercial websites and online services to post a privacy policy. Moreover, the law’s reach stretches well beyond California to require any person or company in the United States (and conceivably anywhere in the world) that operates websites collecting Personally Identifiable Information from California consumers to post a conspicuous privacy policy on its website stating exactly the information being collected and those individuals or companies with whom it is being shared.

Because we value your privacy, we have taken the necessary precautions to comply with the California Online Privacy Protection Act (CalOPPA).

Depending on applicable law, California residents may have the following rights:

  • Know what personal data is being collected.
  • Know whether your personal data is sold or disclosed and to whom.
  • Access to your personal data.
  • Request to delete any personal information about you.
  • Not be discriminated against for exercising your privacy rights.

California residents may also exercise the right to opt out of the “sale” or “sharing” of personal information (as those terms are defined under the CCPA/CPRA) by switching the Marketing category off in our cookie banner via the Cookie Settings link.

11. CHILDREN’S ONLINE PRIVACY PROTECTION

We comply with the requirements of the Data Protection Act 2018 (U.K. regulation), the California Online Privacy Protection Act (CalOPPA – U.S regulation), and the GDPR (General Data Protection Regulation - European regulation) regarding the protection of personal data of minors. Therefore, we do not collect any information from anyone under 13 years of age. Our website and products are all directed to people who are at least 13 years of age. However, if you become aware that your child has provided us with personal information, please contact us. If we become aware that a child has provided us with personal information, we will take steps to delete that information, terminate that person’s account, and restrict access to that person.

12. EDITING AND DELETING INFORMATION

If you believe that any information we hold on you is incorrect or incomplete, please write to or email us as soon as possible. We will promptly correct any information found to be incorrect. You can change, modify, rectify, and delete your information at any time, please do not hesitate to get in touch with us through the contact information. To opt-out of the Somni email, follow the instructions included in the email. Your request should be processed within 48 hours.

13. SUPPLIERS AND OTHER THIRD PARTIES

Except as otherwise expressly included in this Privacy Policy, this document addresses only the use and disclosure of information Somni collects from you. If you disclose your information to others, whether other users or suppliers on Somni, different rules may apply to their use or disclosure of the information you disclose to them. Somni does not control the privacy policies of third parties, and you are subject to the privacy policies of those third parties where applicable. Somni is not responsible for the privacy or security practices of other websites on the Internet, even those linked to or from the Somni site. Somni encourages you to ask questions before you disclose your personal information to others.
